Conditions of Participation
for the “Competitions in December 2021” on Instagram by Concrete Jungle in cooperation with various partners
The following terms and conditions regulate the conditions for participation in the competitions taking place in December 2021 on the Instagram pages of the respective cooperation partners (here: @globusliebe; @birthi91; @gina.ruhl).
By participating in the respective competition, the following conditions of participation are accepted.
1. Organizer
1.1 The organizer of the competitions taking place in December 2021 is:
Concrete Jungle GmbH & Co. KG Gwinnerstraße 46, Halle 408, 60388 Frankfurt am Main (hereinafter also referred to as “Concrete Jungle”) in cooperation with the following partners (hereinafter also: “cooperating partners” or “influencers”) on the respective specific competition,

2. Participation and implementation
2.1 Anyone aged 18 or over residing in Germany, Austria and Switzerland is eligible to participate. Employees of Concrete Jungle and/or the cooperation partners and their respective relatives are excluded from participation.
2.2 Participation in the respective competition is free of charge. Participation in the respective competition is only possible during the period in which the respective competition takes place (see also period).
2.3 Participation in the competition takes place via the Instagram page of the respective cooperation partner for the period of the specific competition.
2.4 The competition consists of the cooperation partners introducing/presenting a set of jewelry they have put together from the “Concrete Jungle” collection on their respective Instagram pages in the form of a post for the designated period of time.
2.5 Concrete Jungle will award one (1 ) Person will be drawn at random who will then win the specific set of jewelry presented (winner).
2.6 The winner determined for the respective competition will be contacted by Concrete Jungle via Instagram via direct message (DM) and then the prize (the respective jewelry set) will be sent to the address provided by the winner at the expense of Concrete Jungle within 14 days transmitted, whereby this deadline is to be regarded as non-binding. When taking part in the competition, the participants agree that Concrete Jungle may contact the respective winner as described above and send the prize to the address provided.
2.7 If a winner does not respond to the prize notification within one (1) week, a new winner will be drawn and the original winner will lose their right to the prize.
2.8 Contact is expressly not made via the respective cooperation partners. It is also not permitted for the winners to contact the cooperation partners directly in connection with the respective prize. The processing, communication and shipping of the prize is carried out exclusively by Concrete Jungle.
3. Period
3.1 The Concrete Jungle competitions scheduled for December 2021 in cooperation with the respective cooperation partners will take place in the following periods:

4. Profit
4.1 As part of each competition, one (1) jewelry set consisting of pieces of jewelry from Concrete Jungle, put together by the cooperation partners and specifically introduced/presented as part of the contribution, will be raffled off.
4.2 An exchange of individual pieces of jewelry is not possible. You can only win the jewelry set presented by the respective cooperation partner.
4.2 The claim to the prize cannot be assigned or transferred. The prize cannot be paid out, supplemented or changed. If the prize cannot be made available, for whatever reason, Concrete Jungle reserves the right to award an equivalent replacement prize.
5. Exclusion of participation
5.1 If these conditions of participation are violated, Concrete Jungle reserves the right to exclude participants from the respective competition. In addition, Concrete Jungle reserves the right to exclude participants who use unfair means or otherwise gain advantages through manipulation from the respective competition. Furthermore, untrue personal information or the use of “fake profiles” or similar can also lead to exclusion.
6. Early termination of a competition
6.1 Concrete Jungle is entitled to cancel, suspend or change the respective competition prematurely, in particular if unforeseen events occur that are outside the sphere of Concrete Jungle and make the original implementation of the competition unreasonable (such as technical problems, manipulation by third parties, Violations of the law that are related to the respective competition).
7. Data protection
7.1. Concrete Jungle collects and uses participants' personal data exclusively to the extent permitted by law and within the scope of the terms and conditions of participation and exclusively to process the respective competition. It will expressly not be passed on to third parties.

8. Disclaimer
8.1 The following exclusions and limitations of liability apply to Concrete Jungle's liability for damages, without prejudice to the other legal requirements for claims:
8.2 Concrete Jungle is liable without limitation if the cause of the damage is due to intent or gross negligence.
8.3 Furthermore, liability arises for violations of essential obligations caused by slight negligence, the violation of which jeopardizes the achievement of the contract, or for the violation of obligations whose fulfillment enables the competition to be carried out properly and on whose compliance the participants regularly rely , a. In such cases, the extent of liability for Concrete Jungle is limited to foreseeable damage.
8.4 Concrete Jungle is not liable for minor negligent breaches of obligations other than those mentioned above.
8.5 The aforementioned restrictions (8.2 to 8.4) do not apply to injury to life, body or health.
8.6 The exclusion or limitation of liability of Concrete Jungle also applies to the personal liability of representatives and vicarious agents of Concrete Jungle and their employees.
8.7 In the event that a piece of jewelry from the jewelry set won is defective, the respective winner must contact Concrete Jungle in text form (e.g. email) within 14 days of receiving the prize and report the defect. After the aforementioned period has expired, an appeal for obvious defects is no longer possible
9. Notices and conditions from Instagram and Facebook
9.1 The competitions, including the processing of the competitions, are not connected to Instagram and/or Facebook. There is expressly no sponsorship, support and/or organization of the competitions by Instagram or Facebook.
9.2 The participants and/or the winners in the respective competition have no claims against Facebook or Instagram. Inquiries and/or any form of communication should always be directed exclusively to Concrete Jungle.
10. Final provisions
10.1 Legal recourse is excluded.
10.2 The law of the Federal Republic of Germany applies, excluding international private law and the UN Convention on Contracts for the International Sale of Goods, which has been incorporated into German law.
10.3 Should individual provisions of these terms and conditions of participation be or become wholly or partially ineffective or void, this will not affect the effectiveness of the rest of the terms and conditions of participation.
